Description
As a significant step towards modernisation of the existing criminal justice system and ensuring a seamless flow of information through electronic and digital resources, the Parliament enacted the three Bharatiya laws, namely, the Bharatiya Nyaya Sanhita, 2023, the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Sakshya Adhiniyam, 2023, replacing the old colonial-era laws, the Indian Penal Code, 1860, the Code of Criminal Procedure, 1973 and the Indian Evidence Act, 1872, respectively. The three new criminal laws came into force with effect from July 1, 2024.
In the realm of the Bharatiya Nagarik Suraksha Sanhita, 2023, the focus has been on consolidation of sections and removal of colonial-era provisions while maintaining the construct similar to the existing law of criminal procedure as enshrined in the Cr.P.C. Considering the radical changes consequent to transformation of Indian social milieu, ethos and moral precepts and advent of digital technology, the statutory rules of criminal procedure needed a more pragmatic approach in the application and interpretation of law to meet the challenges of new emerging crimes and criminals so as to protect the rights and liberty of citizens. An effort has been made to maintain a balance between investigative imperatives and protection of privacy rights of individuals by making the procedure transparent and citizen-friendly.
This book is an endeavour to analyse and examine the statutory provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023, in the form of a well-arranged section wise commentary with their judicial interpretation citing relevant decisions of the Courts. The scope and applicability of various sections with exhaustive notes thereon would certainly make the subject more precise and easily palatable so as to serve as a dependable reference book for the practicing legal fraternity and the law academics.
The book further seeks to provide a comparative appraisal of relevant statutory provisions of the Code of Criminal Procedure, 1973, and the Bharatiya Nagarik Suraksha Sanhita, 2023, and brings to fore their importance as a tool for providing affordable access to justice for the needy litigants. The book also incorporates two Schedules, the first one containing various offences under the Bharatiya Nyaya Sanhita and other laws, and the second embodies various Forms to be used in Bharatiya Nagarik Suraksha Sanhita.
For the sake of convenience of the readers, wherever there is reference to any section of the IPC, Cr.P.C. or Evidence Act, the corresponding section in the new Bharatiya Sanhita/Adhiniyam is indicated within brackets for ready reference.
