Description
The present book was authored as a detailed commentary on procedural criminal law when we were a British colony. The governing law then was the Criminal Procedure Code, 1898. The 1898 Code was repealed in 1973 and with effect from 01.04.1974, the Criminal Procedure Code, 1973 came into force. Most recently, the 1973 Code has also been repealed and the Bharatiya Nagarik Suraksha Sanhita, 2023 (Sanhita) has been enforced.
All the editions of this book containing a celebrated commentary on the subject of. procedural criminal law have so far received an overwhelming welcome response from the readers including members of the bar, the bench, researchers, professionals, academicians and students of law. The commentary has retained its position for being unique in its precision, carries easy readability, critical analysis and has been throughout appreciated for its authenticity.
Keeping with the high traditions set by illustrious predecessors, I have tried that this edition retains the old law while also incorporating the new law in form of the Sanhita. I have incorporated a blend of the old and the new law while revising and updating the book. In addition, I have also tried to give suggestions and critically analyse few judicial pronouncements so that the reader may develop a thought process as to how to simplify the provision and apply it to facts of a case. I seek forgiveness, if due to inadvertence, any important comment has missed mention.
It is our endeavour that the book is useful not only for the bar, the bench, students, researchers and academicians but also proves its utility for those who wish to learn procedural aspects of criminal law in India. The Sanhita will be tried and tested in due course of time. The last word is therefore not said. Perhaps in criminal law it can never be said. Society is vibrant and ever changing. We look forward collectively to the effect of the vibrancy.
