Description
In a society characterized by male dominance and patriarchy like India, a textbook on "Gender Justice and its Application to the Criminal Justice System" can be highly valuable. With the passage of time and centuries, it has been revealed how the Indian legal system has strived to attain gender neutrality in law and how it is applied from the level of a patriarchal legacy. As one looks through the legal literature in India, one can see how greatly dominated by men it has been for the last two or three centuries. Over time, the situation has gradually changed when law has become an instrument of social change, especially in the post-Constitutional period. However, legal research on this topic has revealed that it took a long period of time for policy makers to eliminate the masculinity element in order to achieve a reduced male- dominated legal system. It is undeniable that the Constitution as a primary norm and its influential values have contributed greatly to the achievement of a gender neutral law in India that addresses the problem of gender inequality. A well- known fact is also how great a pain the Indian judiciary, especially the Supreme Court and various High Courts, have gone through to change the Indian people's mind-set in order to create a gender-neutral environment. In the present day, we are living in an era in which transgender rights are being upheld. The Indian Parliament has made an outstanding contribution by enacting a comprehensive law that guarantees the civil and political rights of transgender Individuals.
