Timothy Winter First of all we would like to thank all readers for supporting our book on Landmark Judgements on Religious Issues under the ProBono India's book series. We are delighted to present the second edition of our book with some more important cases filed before the Supreme Court and High Courts. We have witnessed many instances where conflict arose between the right to religion and other prevailing situations from time to time. The essence of Article 25 of our Constitution is beautifully captured in the words of the Hon'ble Supreme Court.
"Article 25 is an article of faith in the Constitution, incorporated in recognition of the principle that the real test of democracy is the ability of even an insignificant minority to find its identity under the country's Constitution. This has to be borne in mind in interpreting Article 25". (Bijoe Emmanuel v. State of Kerala, AIR 1987 SC 748)
This perspective is very essential and should always kept in mind as we continue to navigate the delicate balance between one's individual rights and collective harmony. Our nation has always been a beautifully diversified mix of various religion, cultures and beliefs. And now we live in a globalized world where cultural exchanges and international collaborations has both enriched and complicated our understanding of religious rights. But not everyone thinks alike, and thus we often stand at a crossroads between Social morality and Constitutional morality. With technological advancements, our society finds itself on a platform where tensions arise between modern interpretation and the need to continue advancing and long-standing customs. The Courts play a very important role in maintaining the balance, ensuring peace and justice. This book is a small window to their work.
This edition not only aims to document new landmark judgments but also provoke thought and discussion on the evolving nature of religious rights. Each case included in this book has been analyzed to highlight its significance, challenges, and implications for our legal framework.
