Description
The very object of the instant book is to collect the law bearing upon the particular subject in hand and in bringing it up-to-date. A consolidating law is to be construed by examining the language of such a statute and by giving it, its natural meaning uninfluenced by considerations derived from the previous state of the law. The Code of Civil Procedure, 1908 as its Preamble indicates, is an Act to consolidate and amend the laws relating to the procedure of the courts of Civil Judicature. No doubt it also deals with certain substantive rights. But as the Preamble vouchsafes, the object essentially as to consolidate the law relating to Civil Procedure. The provisions of the code have been evolved as a matter of long year of experience emanating out of the Common Law of England. Courts are guided by spirit of provisions and not be bound by the letters of CPC, 1908. Procedure is meant only to facilitate the administration of Justice and not to defeat the same.
