It is indeed my pleasure to be presenting the fifth edition of Capital Gains. Capital gains taxation, as you would have noticed, is one of the most potent tools available with Governments world over to drive their public policy priorities, especially in connection with their relationship with the external economies. Countries like Singapore, Mauritius, etc. have kept capital gains tax Zero rated to promote global investors to set up shop - clearly the Government's focus is to promote their jurisdictions as global investor friendly hubs. India is one of the most active proponents for using taxation as a tool to augment revenues and, of course, aid policy initiatives. Amidst the news about possible significant reform in the capital gains taxation, including removal of special tax rates for capital gains, there have been some important amendments in the Finance Act, 2023. The restriction of exemption on reinvestment in residential house property to Ten crores and the introduction of new section 50AA to tax capital gains on Specified Mutual Funds as short term capital gains are significant. The number of amendments through the Finance Act, 2023 has been limited when compared with earlier years. The amendments through Finance Act, 2023 and the impact of MLI on DTAAS have been discussed in detail in this book.

Divakar Vijayasarathy, founder and managing partner of DVS Advisors, is a chartered accountant and ex-banker, with strong passion towards domestic and international taxation law.
