It gives me immense joy in placing the present work on Limitation Act. The book has been divided into Seven Parts as under-
The First Part is Preliminary and it deals with Brief History, Nature, Scope and Schematic Representation of The Limitation Act. This Part also incorporates a bird's eye view of the Limitation Act and Flow Chart of Important Sections.
The Second Part deals with Applicability and Definitions. The Third Part tells about Limitation of Suits, Appeals and Applications. Computation of Period of Limitation is covered under the Fourth part. The Fifth Part deals with Acquisition of Ownership by Possession. Then there is the Sixth Part that deals with Miscellaneous Provisions under Sections 29, 30 and 31 of the Act. At the end, there is the Schedule.
Under the Limitation Act, The Schedule is the trickiest part of the Act. It contains 137 Articles that have been drawn in a tabular form. There are 3 divisions as under-
1. First Division deals with Different types of Suits
2. Second Division deals with Appeals
3. Third Division deals with Applications
Depending upon the duration, Period of Limitation for different purposes, the Schedule has been classified. The Period of Limitation as described under the Schedule ranges from 30 years time period to 10 days. The various Articles covering different Period of Limitation have been divided into the period of 30 years, period of 12 years, period of 3 years, period of 2 years and period of 1 year. The Period of limitation for Appeals and Applications ranges from 90 days to 10 days. These have been taken up separately.
The knowledge of Period of Limitation is an important part of every Trial. It is the lawyer at the Sub Division level or the District Court who drafts a plaint and the plaint plays an important role right up to the Supreme Court if the appeal reaches there. There are hardly any books that cover this vital topic as such this makes life of the students and new entrants at the Bar an uphill task. The senior lawyers have neither the time nor the inclination to teach the art of computation of time period.
