Since the publication of the first edition in 1985 a number of important decisions of the courts in England and Commonwealth countries relating to trade marks, trade names and passing off have been reported. Some of the landmark decisions include the Dristan case (Supreme Court, India) (extension of the meaning of 'proposed to be used'); Colgate v Maxwell on parallel imports; and  Reckitt & Colman v Borden (lemon case) (restatement of the "classical trinity"principles of passing off by the House of Lords). Further, cases on service marks; comparative advertising; proprietorship of unregistered trade mark (Al Bassam case); special type of passing off (legal services relating to accident and personal injury); the precise rights of a registered user of trade mark, hearsay evidence, extension of the meaning of bonafide use by registered proprietor in relation to rectification (non-use), effect of use of a trade mark as part of corporate name and so on have been reported The new British Trade Marks Act 1994 introducing substantial changes in the law came into force replacing the old Act of 1938. Some of the provisions of the new Act have come up for judicial interpretation. This second edition in two-volume compilation of 1575 case corporates all the U.K. decisions from 1803 to the end of November 1996. Besides, it now includes a few cases which had been omitted in the previous edition. The importance of decisions of courts in England in the field of trade mark law is recognised in many countries which may be seen from their citations in judgments of courts inIndia, Australia, New Zealand, Canada and so on.Since trade mark law has become truly international in the context of globalization of trade, it is hoped that this compilation of reported cases on the subject will be an indispensable companion to any textbook on trade mark law anywhere in  the world. It will be a handy reference book for both specialists and general practitioners in all countries. As in the previous edition the book contains a table of cases,subject index and an index of trade marks and trade names.
