Description

One of my post-retirement adventures on the literary side was to co-author the diglot edition of a book on the anti-goons law of the State of Kerala, namely, the Kerala Anti-Social Activities (Prevention) Act, 2007 ("KAA(P)A" for short). Undeterred, I settled upon the queer idea of bringing out an exhaustive commentary on all aspects of "criminal trial" running into volumes. But, slowly I realized that my fancy for an all-comprehensive treatise on "criminal trial" was an Herculean rask for which I am not cut out at this age and state of health. I had to painfully drop that challenging mission leaving it aside to well acclaimed doyens in the
field. my Forensic webinars on various platforms became my next passion in life. This pedagogic fervor kept me enraptured in some transient delight. It then struck me that instead of producing two or three bulky volumes of the book which has been life's ambition, it may be more sensible to hatch out compendious booklets on important topics in "criminal trial". A small book means it will be easier to come out with new editions in conformity with the rapidly changing case-law. Some of well-wishers also supported such compendious versions. The topic which I have chosen for my maiden venture is "Tendering Pardon to an Accomplice". The curial exercise of tendering pardon to an accomplice is a power to be exercised not only by the usual courts of the Magistrates and Session Judges but also by the Special Judges under various special enactments. The case- law on the subject of tendering pardon to an accomplice is profuse, complex and misleading at certain areas. Many Courts are even now groping in the dark regarding the procedure to be followed in the complex process of tendering pardon to an accomplice. Every endeavour has been made to familiarize the Bench and the Bar with the elementary steps to be followed towards a fool proof fruition of the complicated process.
