Description

Service matters means all matters relating to recruitments  and conditions of service of government employee under union and States. Articles 14,15,16,309,310,311,315,320 of the Constitution of India are important article in the relation to the service matters. There must exist a relationship of master and servant between the State and the person said to be holding a post under it. Employer has right to appoints a person, regulates the manner and method of the recruitment, pay remuneration and pass an order to termination of service. If any complaint is received against any employee the disciplinary authority shall hold the preliminary enquiry to establish the prima facie case whether to proceed further for the institution of regular enquiry or not. For imposing minor penalties generally summary procedure is adopted but for imposing any of major penalties full  fledged enquiry is required to be followed. In this book an attempt  is made to discuss the very important topic such as equity under Article 14, 15 and 16 in relation service matters, equal pay for equal work, administrative tribunals, services under union and states, Public Service Commission, compassionate appointment, ad hoc appointment, annual performance appraisal report and disciplinary proceedings. I am hopeful that this book will cater to the need of LL.B and LL.M. Students.
