Description
Sale is an inter vivos transfer of property. A person acquires ownership of property by sale. Sale of goods and products are meant to satisfy human wants and desire. Sales are the most celebrated commercial transaction on the earth. Sale of Goods, which is essentially transfer of movable property, is governed by cluster of laws ie., Indian Contract Act, 1872, Transfer of Property Act, 1882 and Sale of Goods Act, 1930. Sale of Goods Act, 1930 was originally the part of Indian Contract Act, 1872 and it was carved out as a new Act in 1930 due to increased industrialization and commercial transactions.
Indian continent has rich physiography which is full of natural resources used for production and manufacturing of goods and products. Equally India is one of the largest populaces of the world and consumption of goods is staggering. Sale and supply of goods is sine quo non for economic prosperity of the country. Sale of goods ensures distributive justice, socialism and economic justice to 'we the people'.
This book is a humble attempt of the author to discuss and deliberate the law enshrined in Sale of Goods Act, 1930. Due to colonial roots, we cannot ignore the English laws on the point and in the book ample space has been given to English cases and statutory provisions. The cases decided by Indian Judiciary has been given due space so as to bring out the best for our readers. This book provides the bare text of Sale of Goods Act, 1930 at relevant places so that the reader does not need it separately. The book includes new cases from India and English Jurisdiction. The author has attempted to deliberate upon the 'Product Liability' under the chapter 'Consumer Sale' due to introduction in Consumer Protection Act, 2019 which makes the work relevant and updated.
The author has made every attempt to include all leading laws, case laws, deliberations and debate of authorities on the subject to make this book authentic and effective. The author in the process of bringing out this book has consulted all relevant authorities on the subject and various research articles written by experts on the subject.
