Description
Property law is governed by the Transfer of Property Act, 1882. Prior to the enactment of the Transfer of Property Act, the law relating to transfer of property was not satisfactory. In the beginning the property law in India was governed by the principles English law and equity. Those principles could not bring uniformity and led to conflict and confusion. The Transfer of Property Act became law on 17th February 1882. The Act came into force on 1st July 1882. The Act is made to bring harmony between rules of transfer of property and its devolution related to immovable property. The property law applies only to transfers by act of parties and it does not apply to the transfers by operation of law. It deals only with transfer inter vivos i.e. between living persons. The property law contains provisions mostly relating to immovable properties and contains a very few provisions relating to movable properties. This law applies only to the transfers which takes place in India and does not apply to the transfers made outside India The person may include an individual, company or association or body of individuals, and any kind of property may be transferred and includes transfer of Immovable Property. Hence the study of property law is very much essential.
