"Prevention of Corruption Act, 1988 is an Act to consolidate and amenc the law relating to the Prevention of Corruption and for matters connectec therewith.
Section 30 of the Act deals with repeal and saving. Sub-section (1) o: Section 30 of the Act says that the Prevention of Corruption Act, 1947 and the Criminal Law Amendment Act of 1952 are hereby repealed. Section 31 of the Act deals with omission of certain sections of Act 45 of 1860.Section 3 of the Act deals with powers to appoint Special Judges. Section 4 of the Act deals with cases triable by Special Judges. Section 5 of the Act deals with procedure and powers of Special Judge. Section 6 of the Act deals with power to try summarily. Chapter III deals with offences and penalties.In Manojbhai Bhagwandas Shah v. State of Gujarat, 2002 Crl.L.J. 2134, the aspect of taking cognizance of offence had been dealt with.The essential ingredients of an offence under Section 7 of the Act had been discussed in L.K. Advani v. CBI, 1997 (4) Crimes 1.The ambit of illegal gratification had been well discussed in State ofAndhra Pradesh v. S. Janardhan Rao, 2004 (9) Scale 523; Varada Rama Mohart Rao v. State ofAndhra Pradesh, 2004 (4) SCC 427.
