Description
India is growing fast in digital advancement and under this paradigm authors and publishers have not been left behind. Most of the legal documents which should be brief and to the point are being copiously enlarged with the very simple 'copy- paste' technique. Particularly, most of the agreements and even other documents are unnecessarily are stretched. The advocates who are generally approached by the clients in drafting the deeds and other notices etc. etc. are also liberal in inserting some of the not very relevant clauses in the deeds and documents. One of the reasons for this may be that because of the large number of judgments, the scope of law has expanded and they want to take every precaution lest it may be interpreted adversely and the whole exercise in drafting could become futile. The other reason is that they not only have to satisfy the clients but also impress upon them to justify higher professional fees to be charged. The advancement of digital technology has made the task of preparing the documents much longer than necessarily required easier because some of the stock clauses are inserted in such drafts which may be referencing to definitions, interpretations, legal implications, sections of enactments, rules, obligations about compliances etc. Nevertheless, the art of legal drafting is surviving against all such odds. While revising the sixth edition of the book 'Legal Drafting - Do It Yourself' we have restricted ourselves to the Indian legal framework instead of imitating or borrowing the British or American deeds and other drafts. More emphasis has been given in drafting of Wills because the disastrous impact of Covid-19 hardly spared any person irrespective of his religion, caste, age who has not lost his near and dear ones. By and large all who are well settled have realised that none of us want to think of our mortality, but like Benjamin Franklin said, "Nothing is certain exceptdeath and taxes". So, should creating a Will be a part of our resolutions now that the pandemic has made us acutely aware of the uncertainty abou' life?
