Description
The Arbitration Act, 1940 in force in India, at that time, did not contain appropriate provisions to deal with issues of domestic and international commercial arbitration and conciliation in the new business environment that followed the economic reforms. In 1985 the United Nations Commission on International Trade Law ["UNCITRAL"] had adopted the Model Law on International Commercial Arbitration with the purpose of enabling uniformity of law of arbitral procedures in all jurisdictions and the specific needs of international commercial arbitration practice. The Model Law of 1985 was amended in 2006. Though the Model Law deals with international commercial arbitration, the basic principles of that Model Law were flexible enough to be adapted with suitable modifications to provide for domestic arbitration and conciliation.
