Description
After a gap of fifty years, the fourth edition of Law of Elections and Election Petitions saw the light of the day. It was a pleasant surprise for me that the book was exhausted within a few months of its publication. This is what an author looks forward to. The appreciation which the author gets from the readers is much more than the monetary gain which he gets in the shape of royalty. I thank all the readers.The present edition is being published within a short span of less than two years. During this period, there has been significant developments of law inasmuch as judgments having far reaching consequences have been delivered. Some of these I am highlighting in the following paras. If a candidate does not disclose the pendency of criminal cases against him where the conviction can be of more than two years and in case his affidavit is silent then his nomination paper can be rejected. Thus, leaving a column blank in the nomination paper can have serious consequences for the candidate. The Supreme Court of India has also dealt with the issue of "Hate Speeches" in Jafar Imam Naqvi v. Election Commission of India," and Parvasi Bhalai Sangathan v. Union of India. The Court, however, left this issue to be taken care of by the Election Commission because judicial restrain, restrained the Court from laying down something which is not there in the Representation of the Peoples Act, 1951.
