Description
No society can progress economically and socially and have peace without proper law and order. A modern State has the advantage of science and technology which is essential for its economic growth. It is observed that remarkable economic growth and expansion of metropolitan cities gave birth to new types of crimes. And therefore, in order to control crimes, one of the most important instruments is he criminal justice system which ought to be just, fair and equitable. For this a modern and civilized State needs proper, effective and relevant criminal laws. This book is an attempt to describe, analyse and critically explain the law of crimes in India particularly with reference to the Indian Penal Code. However, apart from the analysis of offences as provided under the Indian Penal Code, the book explains in detail the general principles of criminal liability applicable under the criminal justice system. The book deals with the historical perspective of criminal law in India and the extent of operations of the Indian Penal Code. It discusses inter alia the doctrine of mens rea andactus reus. It also focuses on the age-old dilemma in criminal jurisprudence relating to mens area versus ignorantia juris. This book is a comprehensive presentation of a section wise commentary with the latest case laws on the subject. It also contains relevant English cases and provides their explanation in order to properly understand various concepts, as contained in the updated Indian Penal Code. The utility and relevance of cases in a book on law can never be underestimated because we have the system governed by the doctrine of stare decisis. The present work has been written in a lucid language, with the object of providing a handy, relevant and useful book. However, even persons interested in criminal jurisprudence can fruitfully make use of this book. It is believed that this is a must for the lawyers and students as well.
