Description
The Immoral Traffic (Prevention) Act 1956, Act 104 of 1956, is an Act to provide, in pursuance of the International Convention signed at New York on 9th May 1950, for prevention of immoral traffic. The Act was amended by Amending Act 46 of 1978 and also further Amending Act 44 of 1986. This Enactment is a social welfare Legislation aimed at preventing the immoral traffic and also for taking further suitable steps in protecting such children, girls or women as the case may be. This Enactment contains 25 Sections apart from Schedule. All the State Rules, the relevant provisions of the Code of Criminal Procedure, Indian Penal Code and also the Constitution of India and all Rules made under the Act and further the relevant Acts and the Declarations also had been given by way of Appendix for better appreciation of the subject.
The Division Bench of Andhra Pradesh High Court had an occasion to deal with the Constitutional validity of Section 17(4) of the Act in the context of Article 21 of the Contitution of India in V.N. Swamy v. S.H.O., Hyderabad, 1998 (1) ALD 755. The scope and ambit of Sections 7 and 18 of the Act had fallen for consideration in Rama Swamy Chettiar v. Deputy Superintendent of Police, Salem, 1976 MLJ (Criminal) 511 and the learned Judge of Madras High Court had dealt with this aspect in elaboration.
