The idea of a private dispute pertaining to matrimonial issues between married individuals being judged and decided upon in a public forum is often a cause of anguish and agony. Unfortunately, however, matrimonial litigation entails the washing of dirty linen in public. The agony of the parties to such litigation, nevertheless, can be minimized if they are expertly guided. I have provided legal counsel to several clients by either advising them on matrimonial issues or by representing them in a court of law. From my experience as a practicing litigator, I have learnt that most litigants seem to have a mistaken impressions about the gravity of the situation that they are confronted with upon being subjected to a litigation. Before contesting a matrimonial case in a court of law, whether in person or by engaging a lawyer, or as a lawyer representing a matrimonial litigant, one must acquire adequate knowledge about the legal options available, the steps that are involved in a litigation, what is expected of a litigant or a lawyer representing a matrimonial litigant, if engaged, and how much time and energy is likely to be consumed by a litigation. This book is an attempt to address these fundamental issues in the context of matrimonial litigation in India. I have focused on the topics of divorce, maintenance, and child-custody. I have made my best efforts to avoid using legal jargon and complex legal terminologies, so as to demystify the idea of matrimonial litigation for an ordinary reader and enable him/her to make practical and informed choices about possible recourse and remedies. The book is designed as an ideal reference/textbook on the topic of Hindu Matrimonial Law, Litigation and Practice for law students, matrimonial litigants, and lawyers. It covers relevant statutory law as well as case-law; and the concepts are explained with relevant case-studies. The book is an ideal guide to practicing law in the Family Courts of India.
