2020 represents the 40th anniversary of the publication of the First edition of this work. Whilst we seem to live in an increasingly confrontational period in some areas of life, both nationally and internationally, the impetus for parties to litigation or arbitral proceedings to resolve their differences before the final hearing is no less strong now than it was then. Whilst the process of settlement, whether achieved through direct negotiation or facilitated by mediation or some other form of ADR, so often bears fruit even when, as now, disputes seem to have become even more complex, there remain pitfalls and unanticipated nuances that need to be identified and addressed in that process. We hope this new edition will help in that regard.
