Description
It has been a challenge for me to write about Expounding Constitutionalism in India. There is no school of thought in any of the Law Schools in India on the thematic thrust of Constitutionalism.' I have been wandering like a monk to gather some gems and pearls from deep sand in the ocean on the theme of Constitutionalism. I scanned the judgments of the Apex Court of India to comprehend the concept of Constitutionalism. It has been a long journey of scanning the intricacies and niceties of cases from 1950 to 2019, namely, a movement from analytical positivism to new judicial Avtar of basic structure, due process, pro bono publico to judicial intellectual activism in the new mil- lennia. Expounding Constitutionalism in India has been a de novo judicial intel- lectualism in up-and-coming millennia; it has been a creative, pragmatic and innovative approach of the justices that centres on State action, social, and eco- nomic welfare rights and the Judicial Role.

PROFESSOR DR. K. L. BHATIA,
B.A. (Hons) (J&K), LL.B. (ILS Pune), LL.M., Ph.D. (Pune), is a senior Professor of Law and an eminent legal personality. The former Head and Dean, Faculty of Law, and Founder Director, The Law School, University of Jammu; Director, Amity Law School; Founder, Dean and Professor Emeritus, College of Legal Studies, University of Petroleum and Energy Studies, Dehradun; and Professor of Law, National Law University, Jodhpur, he has over four decades of teaching and research experience. He has published over twenty books on varied research subjects of law, both doctrinal and heuristic, including Federal Structure of the Textual Constitution of India: Fons Juris of Constitutional Patriotism; Cases and Materials (2019), and over a hundred research articles in leading peer legal journals of repute in India and abroad. Dr. Bhatia has also written a book of poetry in both Hindi and English. His areas of interest are Constitutional Law, Administrative Law, Human Rights, Research Methodology, Legal Methods, Legal Language and Legal Writing. The recipient of ICSSR, UGC, J&K State, UN and ILO Human Rights fellowships, he is a DAAD and Max Planck Fellow and Alumnus.
