Procedural laws provide the route map for effective implementation of the substantial laws. Unless there is clarity and precision in procedural law, it becomes cumbersome for the litigant to enjoy the fruits of justice. Code of Civil Procedure lays down the procedure for conduct and execution of cases which are of civil nature. CPC has stood the test of time. Nevertheless various amendments have been brought into force to adapt the law to new circumstances. Apart from the statutory changes, the interpretation of various provisions of law also underwent a sea change with elapse of time. For a busy lawyer, to know or to be accustomed with the statutory provision in conjunction with the latest judicial interpretation is imperative to work out the legal remedies one can seek in a Court of law. In this fourth edition of the book, we have incorporated the latest case law on subject under the relevant Sections and Orders. We sincerely hope that this book in its new form will be of great use to its readers. We welcome suggestions for improvement as well.
