Description
The transition from The Code of Criminal Procedure, 1973 (CrPC) Nagarik Suraksha Sanhita, 2023 (Sanhita) is fresh and challenging. The idea behind this project is to have a text richer than the bare act but not as voluminous as a commentary. Therefore, we designed this hybrid model of having a primer/concise commentary between a bare act and a commentary. Another problem which the readers were t to have to go back to the comparative table between CrPC and Sanhita for provisions.
That we have resolved in this book in the short comments after each section.
mentorship I would not have been able to take on this project without the constant of Hon'ble Mr Justice Anil Kumar Upman, judge Rajasthan High Court. It is his immeasurable guidance in shaping me to practice criminal law that I have had the courage to write on procedural criminal law.
Given the professional commitments and constraints, I would not have been able to complete the task assigned by LexisNexis India in an almost rigid time frame, had it not been for the untiring assistance extended by a young scholar of law, who in my opinion has immense potential—Mr Divik Mathur, Advocate. I acknowledge my indebtedness to Mr Divik who has spent long winter nights pouring and comparing on the old laws and the Sanhita to ensure that we are able to achieve accuracy in what we have written. I give special credits to Mr Swapnil Upman, another young scholar in law, presently studying at the Jindal Global School of Law, Sonepat. Mr Upman ably assisted in picking up the case law, gave crucial inputs on the subject and cheerfully gave up his break so that this book may see the light of the day.
I am thankful to the team from LexisNexis India, namely Mr Arjun Bhargava, Ms Shelja Jandyal and Ms Kanika Gupta who drove me relentlessly forward, pushed us and pestered me too to compete the project on time. But for their persistence, this book would not have found place in your hands on time.
I also thank Justice Sandeep Mehta for taking out time and writing a foreword for us. His wishes for the project means a lot to all of us.
The Sanhita will be tried and tested in due course of time. The last word is therefore not said. Perhaps in criminal law it can never be said. Society is vibrant and ever changing. We look forward collectively to the effect of the vibrancy.
I dedicate this book to COVID Warriors who fought a courageous battle for all of us. The law is stated as on 17 February 2024.
