Description
Over 80 years have passed since the first edition of this textbook was published in 1937, and it now runs to 20 editions. Although certain aspects of the law of torts have remained largely static throughout this period, some of its features have been transformed almost beyond recognition, and much has also changed since the 19th edition was published in 2014. gada atro Some of the more significant recent developments of which account is taken in this edition include the Supreme Court's decisions in: (1) Robinson v Chief Constable of West Yorkshire Police [2018] UKSC 4; [2018] A.C. 73, which makes it clear that the experiment with the so-called Caparo "test" for the existence of a duty of care has failed; (2) Michael v Chief Constable of South Wales [2015] UKSC 2; [2015] 1 A.C. 1732 and Poole BC v GN [2019] UKSC 25; [2019] 2 W.L.R. 1478, which confirm that the general no-liability rule for omissions applies with equal force to public authority defendants; (3) Patel v Mirza [2016] UKSC 42; [2017] A.C. 467, which raises formidable issues regarding the illegality doctrine as it applies in the law of torts; (4) Willers v Joyce [2016] UKSC 43; [2018] A.C. 779, which extends the tort of malicious prosecution to civil proceedings (a development advocated by Winfield in the early editions of this work); and (5) no fewer than five major decisions on vicarious liability and non-delegable duties, including most recently WM Morrison Supermarkets Plc v Various Claimants [2020] UKSC 12; [2020] 2 W.L.R. 941 and Barclays Bank Plc v Various Claimants [2020] UKSC 13; [2020] 2 W.L.R. 960, which judgments call at least a temporary halt to the offensive on which the Supreme Court had previously embarked to expand the boundaries of vicarious liability. Other noteworthy decisions of the Supreme Court and Privy Council of which account is taken include O v Rhodes [2015] UKSC 32; [2016] A.C. 219 (intentional infliction of physical or emotional harm); Dryden v Johnson Matthey Plc [2018] UKSC 18; [2019] A.C. 403 (damage); Williams v Bermuda Hospitals Board [2016] UKPC 4; [2016] A.C. 888 (factual causation); Campbell v Peter Gordon Joiners Ltd [2016] UKSC 38; [2016] A.C. 1513 (breach of statutory duty); Lachaux v Independent Print Ltd [2019] UKSC 27; [2020] A.C. 612 (defamation); JSC BTA Bank v Ablyazov (No.14) [2018] UKSC 19; [2018] 2 W.L.R. 1125 (conspiracy); and Fish & Fish Ltd v Sea Shepherd UK [2015] UKSC 10; [2015] A.C. 1229 (joint tortfeasance).
