Description
JAR (Wealth), JORU (Women) and Zameen (Property) are the three main areas wherein disputes arise and litigations go on till generations. These give birth to laws relating to Firstly, Taxation, Partition, Successions, secondly, to family law and thirdly to land laws. Property is involved in all the three. Property earlier was bracketed as fundamental right with life and liberty. 44th Amendment of Constitution of India has deleted Article 19(l)(f) which dealt with fundamental right to property in 1979 with effect from 20th June, 1979. This Amendment, inserted Chapter IV (Art. 300-A) in Part XII of the Constitution of India and fundamental right to Property got converted into a Constitutional right by this exercise. The reason is, too many cases involving 'Property' as fundamental right. The right not to be deprived of property is save except by authority of law no longer finds place in Part III that is 'Chapter on Fundamental Rights' but has been reduced from say 'A' category right with benefit of Article 32 into 'B' category right under Article 226/227.
