Description
The object of the General Clauses Act, 1897 is to abbreviate the language of the Central Acts, to provide as far as possible uniformity of expressions in Central Acts by giving definitions of a series of terms in common use, to state explicitly certain convenient rules for construction and interpretation of Central Acts and to guard against slips and oversights by importing into every Act certain common forms and clauses, which otherwise ought to be inserted expressly in every Central Act. The General Clauses Act is a part of every Central Act and has to be read in such Act unless specifically excluded. The importance of the General Clauses Act can never be over-emphasised. If there is one basic and cardinal rule of interpetation of Statute, it is this that one must not imply anything in them that is inconsistent with the words expressly used. And the question what the words "expressly used" means, arises so often and in so many forms and shapes. To answer the question thus arising one has to fall upon the provisions of the General Clauses Act. The provisions of the Act have been lucidly and carefully expounded and incisively analysed in the light of up to date judicial decisions. In fact, wherever possible, the language and words employed in the judicial decisions have been reproduced verbatim to lend full and complete authenticity to the commentary on the subject. Every possible effort has been made to incorporate almost all the cases decided by the Supreme Court as well as various High Courts till date.
