Description
First published two years ago, this book was hailed in various sections of the legal fraternity. It has now been thoroughly revised and updated. The first edition was arranged in three Parts - one each covering apex court cases on Marriage and Divorce, Children and Minors, and Property and Succession. New points have now been added to both the texts and the endnotes in all these Parts.
In this edition a Supplement has been added after Part III, analyzing eight new cases of 2022-23. Among these there are three important cases on women's rights which are pending in the court and will, hopefully, be decided in the forthcoming months.
The Supreme Court has from the very beginning been deciding cases on religious beliefs and practices of the Muslims, which were not covered in the first edition. In this edition nine select cases of this nature, beginning with the first cow protection case of 1958 and ending with the Hijab case of 2022, have been briefly analyzed in the newly added Part IV. Each of the first three among these was, notably, decided by a Constitution Bench.
The total number of cases analyzed in the first edition was 61. In this edition the number has risen to 78. Many other cases, old and new, have been referred to in the endnotes in all parts of the book.
I humbly present this new edition of the book to the Nation in the 75th year of the Republic.
