Description
Courts always face dilemma at the time of dealing with the case of death sentence. The dilemma multiples manifolds when our honorable President of India Prof. Abdul Kalam raised an issue why does the capital punishment confine only to weaker sections of the Indian society? This issue was again faced by me at the National Judicial Academy when I got an opportunity to became the part of an orientation course. This controversy inspired me to know whether our Judicial System is biased towards the culprits who belong to the weaker sections of the society or to any particular community or any particular class, at the time of awarding death sentence. This avidity of mine prompted me to study all cases where either the death sentence was upheld or converted into life imprisonment by the Apex Court.
