Description
The Civil Procedure Code, 1908 is the Grund Norm on which all civil litigation is based. This is so whether CPC applies proprio vigore in civil suits, or as a guiding North Star in all other kinds of litigation. As repeatedly held by the Supreme Court, even if CPC is not strictly applicable in a particular case, the principles contained in CPC are of such general import that they can rarely be ignored completely.
In the last about 68 years, the Supreme Court case law on CPC has come to govern almost every important aspect of civil litigation. In this process a great deal of High Court case law has been synthesised and rationalised by the Supreme Court. It is well known that under Article 141 of the Constitution the law declared by the Hon'ble Supreme Court is binding on all courts. Hence, it has become absolutely imperative to have a detailed and exhaustive source of Supreme Court rulings on CPC. Often, it takes a few years before the Supreme Court case law is adequately represented in leading textbooks on CPC. Thus, this three-volume digest, Supreme Court on Civil Procedure Code, can be referred to independently as a complete source of Supreme Court case law on CPC from 1950-2018. Equally valuably, it can also be used as a complement to complete leading textbooks on CPC. It is hoped that this truly exhaustive and up-to-date work on CPC will aid the trial courts and other fora of first instance to decide cases before them in consonance with the latest Supreme Court case law. Not only would this lead to quicker adjudication, but also reduce the need for unnecessary appeals, as the case would have been decided on the basis of Supreme Court case law in the first instance.
