Description
An injunction is an instruction that can be applied by a court that compels a party either to perform, or to refrain from doing certain actions (often both). It is a legal and equitable remedy. This law originates in equity. Injunctions are issued under the doctrine of equity, which seeks to judge based on what is fair, as opposed to what the law instructs. Law of injunction in India has its origin in the equity jurisprudence of England. Since it is an equitable remedy, party is expected to come with clean hands. There must be breach of an obligation or infringement of a legal right for the relief of an injunction. Failure to follow the requirements of an injunction is considered contempt of court, and the party can face criminal and civil penalties. An injunction is an order issued by a court that forces the defendant a person, corporation or government entity-to do something or stop doing something, depending on what the plaintiff is requesting. In relatively rare cases, the court may issue a mandatory injunction, compelling a person, company, or governmental unit to take affirmative action in carrying out a specified action.
