Description
My aim in writing the fifth edition of this book has been the same as it was for all previous editions, to provide students with a book that combines extracts from the decided cases and other materials with a substantial commentary of the provisions of law. Each Act has been preceded by its historical background to generate interest in this subject. To ensure clarity and easy understanding of the subject, each concept has been supported by judicial interpretations and case laws, at appropriate places. Courts and Legislature have been very active in the six years since the last edition of this book was published in 2011. This extensively revised edition takes account of scores of new judgments and includes extracts from the most significant cases decided after the release of fourth edition. This edition incorporates the major changes introduced by the EPF Act, 1952 (in the year 2014 & 2017); ESI Act, 1948 (in 2017); Industrial Disputes Act, 1947 (in 2017); Payment of Bonus Act, 1965 (in 2015); Payment of Wages Act, 1936 (in 2017); and the Employee's Compensation Act, 1923 (in 2017). However, new cases included in this edition are too numerous to list fully. The revised edition of this book is designed mainly for the benefit of post graduate students in universities and professional bodies. However, given the growing interest in labour reforms in the country, I hope that a wide range of other readers may find the book of use. The book would be of immense use to legal practitioners, chartered accountants, company secretaries, cost accountants, managers, law officers, employers, employees, trade unions and all those interested in the study of labour laws in the country.
