Description
I have had the privilege of editing the last four editions of Rustomji's Law of Limitation and Adverse Possession, a legal classic indeed. The duty of an editor is not merely to include up-to-date case laws but to interpret the law as well, whenever such occasion arises. The Limitation Act is an on-going statute. In case of conflict of opinions I have given my own views following the principles generally recognised in interpreting an on-going statute as highlighted by Francis Bennion in his treatise titled 'Statutory Interpretation', 2nd Edition: "An enactment of former days is thus to be read today, in the light of dynamic processing over the years, with such modification for the current meaning of its language as will now give effect to the original legislative intention". At the same time one must be careful so that the dead hand of the past may not stifle the growth of the living present. Law cannot stand still, rather it must constantly be on the move adapting itself to the fast changing society and not lag behind. Lots of new provisions like Insolvency and Bankruptcy Code, 2016; Commercial Courts Act, 2015; Arbitration and Conciliation Act, 1996 with case laws have been included in this edition. I sincerely hope the present edition like the previous ones will meet the requirements of both the Bench and the Bar.
