Description
Land is one of the scarce natural resources in the world, thus, it is not possible either to increase or decrease the land and as such it is to be ensured that land is managed judiciously and in a manner suitable to the common good of people. Every individual has a natural and inherent right to own and possess the property. The right of the individuals conflicts with the right of the State to acquire property under the doctrine of eminent domain. A high public concern has long been felt regarding land acquisition issues in India. Despite many amendments, over the years, to Land Acquisition Act of 1894, there was an absence of cohesive national law that addressed fair compensation, when private land is acquired for public use and the rehabilitation of land owners and those directly affected from loss of livelihoods. A combined law was found necessary, one that legally requires rehabilitation and resettlement and simultaneously follow Government acquisition of land for public purposes.
