Description
Long awaited amendments in R.P. (U.P.) Act have come up after 46 years in 2012 for better Railway Protection. The RPF has been empowered to deal with the additional offences of Theft, Dishonest misappropriation and abetment, conspiracy thereof relating to railway property. Never before, in the history of criminal law legislation, a non-police organisation like RPF has been trusted so much by the Parliament. This amending Act of 2012 has some ingredients of Section 5 of the T.A.D.A. Where confession recorded by RPF can be used not only against the co-accused in one case but in other cases also under certain circumstances. (Surya Rao v. State of Maharashtra, AIR 2001 SC 143). Since no judicial pronouncement of higher courts are available on the latest R.P. (U.P.) Act, Amending Act of 2012, inferences have to be drawn from Police cases under the Doctrine of Necessary Implication. Besides, all the necessary decisions of High Courts and Supreme Court have been added and case studies have supplemented the provision of laws to explain the binding nature of the Special Act with formats.
