Description
The Law of Limitation is indeed an important law on the Statute book. It is in furthence of the sound public policy to put a guietus to disputes or grievances of which, resolution and redressal are not sought within the prescribed time. The Law of Limitation is intended to allow things to finally settle down after a reasonable time and not to let everyone live in a state of uncertainty. It does not permit anyone to raise claims that are old and state and does not allow anyone to approach the higher tiers of the judicial system for correction of Lower Court's orders or for redressal of grievances at one's sweet will. The Law of Limitation indeed must get due respect and observance by all Courts. Law of Limitation is an adjective law. It is a lex fort. Rules of limitation are, prima facie, rules of procedure and do not create any rights in favour of any person nor do they define or create causes of action but simply prescribes that the remedy can be exercised only upto a certain period and not subsequently. The reception accorded to the Eighth Edition was so overwhelming that this edition sold out within few time of its publication. This Ninth Edition is in real sense a thoroughly revised and enlarged edition which covers entire range of case laws up to November, 2016 decided by the Supreme Court as well as various High Courts. Several portions of the book have been re-written, and new case laws have been added to and obsolete matters deleted to make the book more user friendly.
