Description
After the first edition of this Treatise was published in July, 2017, significant amendments have been made in Benami Act by the Finance (No. 2) Act, 2019 and the Finance Act, 2021. This was the main reason for updating the commentary and bring out this completely revised second edition. Substantial portion of the first edition has been revamped with significant improvements. The covid pandemic gave me the opportunity to complete this second edition by utilising the time saved from the relief from my daily commute to office. The pre-amended benami law was enacted on 5 September 1988 and was in existence till 1st November, 2016 when it was substantially amended. As a result of such amendments, the Act was enlarged from the erstwhile nine sections to seventy-two sections post-2016 amendment. It is a matter of surprise that for almost three decades (between 1988 and 2016), there was no effort to give effect to recommendations of Law Commission to improve
Benami Law.
