Description
The Legal Metrology law being a consumer protection law has become a subject of paramount importance today. As consumer awareness has increased, so has the stringent application of the consumer protection laws including legal metrology law. A due diligence by the consumers on the information provided on an MRP label and/or advertisements has become a common norm in recent times. In light of recent developments in the country both economically (such as Make in India initiative) and politically (Indo-China border tensions), the finer aspects of legal metrology law have often been in news for various reasons such country of origin' requirements or selling of packaged foods in malls, restaurants etc. at a price higher than MRP etc. in recent times. Interestingly, Hon'ble Late Shri Ram Vilas Paswan, erstwhile Minister of Consumer Affairs, Food and Public Distribution had also been quite vocal on these issues. The Legal Metrology Act, 2009 was preceded by the Standards of Weights and Measures Act, 1976. Over a period of time various High Courts and the Supreme Court have given important principles on some of the most intricate and fundamental aspects of this law. While the Legal Metrology Law deals with various facets of weights and measure; in my personal experience, the labelling and advertising aspects of the law have come across as an interesting area of research for me. One of the reasons for the same may be that the drafts of the requisite legislations under this law are not as elaborate as other major labelling regulations such as those provided under the food laws and drugs and cosmetics law. This gives space to ambiguities and thus, a greater room for interpretation.
