Description
The Indian Penal Code, 1860 has been in force in India since the last more than one hundred and sixty years with least amendments. Over the years, its provisions have been legislatively as well as judicially scanned and perceived to read them in tune with thechanging facets of the constitutional and social ethos. Nevertheless, some of these changes, the values and ideals on which they are being constructed, and their inter-play with corresponding social & individual 'outlook' still stand debatable. Construction and de-construction of criminal law, as observed in Preface to the earlier edition, can hardly be put into a definite theoretical paradigm, or convincingly justified on socio-political ethos. Making and unmaking of 'crime', and thereby of 'criminal law', remains a complex dynamic process. The present fifteenth edition, without altering the structural outlay followed in the earlier editions, endeavours to incorporate, at the appropriate places, the changes brought in, and the renewed judicial facets added to, certain provisions of the Penal Code since the last fourteenth edition was published in 2019. A care has also been taken to put these changes in the right place, with apt comments and reflections. The changes proposed by the Law Commission of India and other Committees are also highlighted and examined in the respective chapters to offer them a holistic view. Some of the chapters are re-visited to tune their theoretical contours with the emerging ones. All the chapters are reviewed in the light of the post-fourteenth edition leading judicial pronouncements, legislative amendments, and juristic opinions.
