Description
Since the publication of the last edition of the book, certain important changes have been made by the Finance (No. 2) Act, 2019 in relation to taxation of societies. For grant of registration W/S 12AA or approval u/s 10(230) to a society, the Commissioner us of Income Tax shall satisfy himself that the society has complied with all legal requirements as are material for the purpose of achieving its objects. Any subsequent non-compliance of any such legal requirement shall also entail cancellation of registration/ withdrawal of approval. Rates of surcharge have been increased to 25% and 37% respectively where total income exceeds Rs. 2 crore and Rs. 5 crore. As per Taxation Laws (Amdt.) Ordinance, 2019, the rate of surcharge shall be limited to maximum 15% in respect of income by way of capital gains from securities. Besides, procedure and forms relating to Foreign Contribution have also undergone significant changes. The State of Haryana has incorporated its own legislation for registration and regulation of societies. Act and Rules framed by many other States have also been amended. Incorporating the aforesaid and other changes we are now presenting this 28th revised edition of Nabhi's FORMATION & MANAGEMENT OF A SOCIETY, 2020. The Societies Registration Act, 1860 is a central legislation. Most of the State Governments have adopted the principal Act as the law regulating societies in their States. Many of these States have also enacted certain amendments to the principal Acusuiting their requirements. Besides, some States have enacted their own legislation for the purpose. Moreover, certain State Governments have framed their Rules for implementing the provisions of the Act in their States. Thus, the law regulating societies is State-specific and societies in different States require to know the provisions regulating them in their respective State. The book, therefore, incorporates the law applicable in various States for the reference of numerous societies functioning all over the country The book provides every information required for setting up and managing societies for schools, clubs, hospitals, charitable institutions, trade associations and the like with the help of decided legal cases and with reference to State laws and other relevant literature. The book has been designed as a self help manual for societies, providing in and understandable language, guidance for drafting of memorandum and bye laws the society, procedure for its registration, formats of important resolutions, status rights and liabilities of members, working and management of the societies includin duties of governing body, accounts, audit and litigation. Procedure relating to alter action of name, objects and bye laws of a society and those relating to division amalgamation and dissolution of a society have been explained in a separate chapter Powers and duties of the Registrar have also been dealt with separately. The chapter on 'Offences and Penalties', covers all offences cognizable under the various Stat enactments. Besides, a separate chapter has been devoted to registration of a Society a non-profit company.
