Description
While working on the present edition, the debate relating to Muslim personal law is on the rise. The Central Government is keen to make stringent reforms to the archaic Muslim personal law. The matter relating to Triple Talaq, Halala, Polygamous marriage, Uniform Civil Code are now in the periphery of the court. The Supreme Court on August 22, 2017 has rendered its historic verdict in the case titled Shayara Bano v. Union of India and others deciding against the practice of Triple Talaq under the Sharia Law. It is perhaps the first time in the history of the Supreme Court when a constitution bench has been constituted comprising of judges subscribing to different religions (Hindu, Sikh, Muslim, Christian and Parsi). Now ball has landed in the Court of the Government to enact a legislation within the given 6 months period. In view of the upsurge in the Indian Society (as a whole) demanding equal rights for men and women on the basis of Gender Justice, changes in the Muslim Personal Law are very likely to come in the future. It is too early to say that whether a Uniform Civil Code envisaged under Article 44 of the Constitution of India is the need of the hour, however, the country is undoubtedly heading towards it.
