Description
It has been an honour to work on the sixth edition of Mulla The Law of Insolvency in India. 'Mullla's lectures on insolvency law are the authoritative resource on personal insolvency law in the country and provide fascinating insights into the history and workings of the Presidency-towns and Provincial Insolvency Acts. I am particularly grateful for the fantastic learning experience that editing this book has been for me. Since the publication of the fifth edition of Mulla The Law of Insolvency in India in 2013, there have been important developments in the area of insolvency law in India, a field that until this point, had been dormant for several years. In 2014, the Central Government constituted the Bankruptcy Law Reform Committee to look into insolvency law reform in India. The mandate of the Committee was initially to look only at corporate insolvency law reform, driven largely by the crisis of non-performing loans that plagued the banking sector and the difficulties posed by the then existing framework for corporate insolvency law in achieving a timely rehabilitation or liquidation of companies. However, the Committee soon expanded its mandate to include the insolvency and bankruptcy of individuals and partnership firms in an effort to make the law reform effort in this area as comprehensive as possible.
