Description
The Motor Transport Workers Act is applicable to all motor Transport under takings employing five or more motor transport workers. This being a Central Act, the State Governments are given powers to apply all or any of the provisions of this Act to any motor Transport undertaking employing less than five Motor Transport Workers. As such the Government of Kerala issued notification and in Kerala the said Act is applicable to all motor Transport undertakings having one or more employees. This act was enacted for the welfare of the Motor Transport workers.
The object of this enactment is to have an in dependent legislation applicable to Motor Transport Workers as a whole for regulating the various aspects of their conditions of employment, work and wages. It is considered desirable to have separate legislative measure for Motor Transport Workers which would cover matters like medical facilities hours of works, spread over, rest periods, overtime, annual leave with pay etc on the anology or similar enactments for workers in factories and plantations.
Presently, there are certain enactments like Motor Vehicles Act and the Factories Act which covers certain sections of a motor Transport Workers and certain aspects of their conditions of employment.
There are three types of wages. They are living wages, fair wages and minimum wages. Minimum wages is the lowest and the living wages is the highest wages. Fair wages are in between. In Kerala fair wages was fixed only in one employment ie the Kerala Motor Transport Workers Payment of Fair Wages Act and the same has been amended during the year 2023.
This book is a comprehensive book in respect of the Motor Transport Workers in the State of Kerala. I have tired to include all the available particulars in respect of Motor Transport Workers. My earnest attempt is to incorporate upto date decisions rendered by various High Courts as well as Supreme Court. The industrial policy and labour policy lays strong emphasis on Labour reforms for creating an industrial Friendly and conducive labour environment.
