Description
The years since the third edition in 2011 have seen the greatest revolution in insurance law for a very long time. Even the Marine Insurance Act 1906 was intended only to codify the common law, whereas the Consumer Insurance (Disclosure and Representations) Act 2012 and the Insurance Act 2015 make fundamental changes to the law of pre-contractual disclosure and to the law on warranties in insurance contracts. All insurance lawyers know that dissatisfaction with the previous legal position goes back a very long. When the Law Commission reported on these topics in 1981 their report lucidly summarised some long-standing grievances about the way in which the law was seen as unduly harsh on policyholders.
