Description
A man's right to health has no value until it is protected by the State. It is trite that best medical practice is founded upon the ethical principles that guide health care providers who care for patients or perform research. The fundamental principles of ethics of medicine are autonomy, beneficence, non maleficence and a sense of justice. Patients must show the ability for decision making so as to make decisions about their health care. In many situations a surrogate decision maker may have to be appointed to make decisions for patients who lack the above capability, In most circumstances, a parent or guardian is required to make decisions for minors under the control of the parents, Patients have the right to a proper and complete disclosure about their health, medical status, medical records, and involvement in research protocols, I hope this third edition provides a resource for scholars, students, practitioners, teachers, and interested members of the public. Each chapter throws light into the basic issues in Medical Law. Since the last edition of this book the Medical Law has developed in several respects. The Medical Termination of Pregnancy Act was amended in 2021. Legislature had decided to regulate assisted reproduction by way of Assisted Reproductive Technology Regulation Act, 2021 and The Surrogacy Regulation Act, 2021. Public private Partnership in the health care system of India is also analysed in this book. National Medical Commission Registered Medical Practitioner (Professional Conduct) Regulations, 2022 will replace Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations 2002. I have tried to explore the key concepts and trends in Medical law. This takes in the risk of too cursory a review for lawyers new to the study of Medical law while reviewing concepts too elementary for experienced medical law practitioners and students. But at the same time I believe this approach illuminates the paradoxes of Medical law.
