The concept of Mediation is an ancient concept from times immemorial and though the present Mediation Act 2023 is enacted recently, there had been several Legislative provisions in different enactments even previously dealing with mediation and conciliation. Illustratively we can have a glance at certain provisions of Code of Civil Procedure, Arbitration and Conciliation Act, 1996 Hindu Marriage Act 1955, Family Courts Act 1984, Legal Services Authorities Act, 1987, Micro Small and Medium Enterprises Development Act 2006 etc.
This is a brief commentary on the Mediation Act 2023 and apart from this Enactment, the other relevant and connected material for proper and better understanding of the Topic also had been given. Certain decisions useful in this regard too had been arranged and placed at appropriate places.
