Description
Poverty has not only created many socio-economic problems but gave birth to new legal problems. The present adversarial form of administration of justice borrowed from English legal system is very costly and quite unsuitable to Indian society. Legal provisions and procedure are very complicated and cumbersome. Sometimes, the downtrodden, vulnerable and weaker section of our society cannot afford the cost of litigation and hence denied equal access to justice. After independence, the Government of India as well as
State Governments have made vigorous efforts to provide legal aid to needy persons and successfully launched legal aid schemes and programmes. Article 39A was added in the Constitution by Forty-second amendment as one of the Directive Principles. The Article 39A provides that the State should ensure equal opportunities to all for securing justice so that no person can be denied justice only on the ground of economic disability. The Code of Criminal  Procedure and the Code of Civil Procedure have been amended to provide free legal aid in criminal and civil cases respectively. The Parliament has also passed the Legal Services Act in the year 1987, which came into force on 9 November, 1995. The bar, bench, law schools, voluntary organisations etc. have also extended their full co-operation in implementation of national legal services programme.
