Description
The number of cases and issues pertaining to medical termination of pregnancy in India are steadily rising. The need to revisit the current law of abortion in India has been gaining significance. Advances in science and technology today enable detection of foetal abnormalities and determine if the child will be capable of extra-uterine life. Also present are issues relating to whether or not a pregnant women should have complete autonomy over her body pitched against the right of the unborn child to actually be born. The law relating to abortion in India in its current shape appears to be ill-equipped to handle these complex issues. The Legal and Philosophical Study of Abortion examines whether there is a need to increase or totally do away with the upper limit of medical termination of pregnancy by amending the MTP Act; whether the Amendment Bill of 2014 caters to the deficiency of the MTP Act by relaxing the upper limit of termination of pregnancy, and whether the preconditions associated with the medical termination of pregnancy, such as grave injury to the physical or mental health of the pregnant woman, serve any purpose  in this day and age or if they are an unnecessary restraint on the choice of the pregnant woman. The Legal and Philosophical study of Abortion also delves into the legal, philosophical, feminist and socio-religious debates surrounding abortion and supplies the reader with some recommendations.

The topics covered in this book have traditionally been considered as falling within the realm of feminism. The author attempts to overcome this stereotype and emphasises on the fact that it is high time to put an end to such thinking and that it is for men to come out in support of issues faced with the other half of the population. The cross of feminism is not just for the women to bear, it is the moral duty of men to acknowledge the issues faced by the women and be vocal in their support. The author hopes that this moral appeal resonates with the readers of this book.
