Description
Change is the law of nature hence it is inevitable process in modern society. A remarkable feature of 'employer-employee' relations in the wake of globalization is the gradual withdrawal of State from its traditional role of actively supporting organized labour. Labour law reforms remains a taboo but both the judiciary and adjudication machinery have been more willing than before to entertain the concern of the industry. The law also does not standstill. It moves continually. Indian Laws and Rules are alos not static they go on changing, sometimes by the Legislatures, but mostly by the lively and intellectual interpretations of the judges of the Supreme Court and High Courts. The basic law relating to leave, holidays and absenteeism in industries is, although, not amened by the Legislature, yet at places, drastic changes have ocurred, owing tothe decisions rendered by the courts. That is why, the need to revise this book with latest decided cases was felt and efforts have been made to put in latest case laws and the proforma that are needed for use by managers as well as employees. the test of reason and justice cannot be abstracted. They cannnot be divorced from the needs of the nation. the tests have to be pragmatic otherwise they would cease to be reasonable. All round changes with great speed and momentum are taking place in the field of economy and industries. This aspect has much bearing on the interpretations of the laws also. In this revised edition, we have exhaustively dealt with the absentieeism, its causes and cures, as well as the chronic problem of oversataying of leave.
