Description
An easement is a non-possessory interest over another's land whereby the holder is entitled to use such land in a specified manner. Easement, which is an incorporeal hereditament, enjoyed by the owner of a specific parcel of land over neighbouring land belonging to another. The land benefited by the easement right is the dominant tenement while the land burdened with the right is the servient tenement. Easements include one's right to do or continue to do something or to prevent or to continue to prevent something in connection with or in respect of another's land, for the advantageous enjoyment of his own land. The incidence of easements and their non-possessory nature suggest creating a matchless set of considerations while forming, interpreting, and fulfiling such a precarious right. It's highly essential to have a basic understanding of the way the right is created, it's scope, transfer ability, and mode of termination.
