Description
The law of torts is a field of law that applies and regulate our day to day affairs. It guides us not only to our duties, like; the duty to take carebut also to the dutiful omissions, like; not to trespass. Law of tort as any other law, is a rule of human conduct accepted by the society and enforced by the State for the betterment of human life but it is the applicability that makes the law of tort distinct. It was only this significance of the law of torts and its multi-faceted character that triggered the idea of writing this book. Since its inception, the idea turned out to be an opportunity to bring all the elements of torts in the realm of one book. The concept of writing such book is more delightful, when it includes a blend of creativity in the form of the examples and illustrations borrowed from the day to day life and conventional knowledge procured from the primary and secondary sources of information including ever changing judicial approaches and pronouncement. The book "Law of Torts" is an endeavour to ensemble all the relevant provisions related to the law of torts in 14 chapters each chapter highlighting a distinct aspect of torts. The book primarily focuses upon the basis of the law of torts, its nature and definition, through discussing all the elements of the torts in detail and distinguishing it from crime, breach of contracts etc. Another basic element relating to the capacity of a person and the related provisions thereto, in the law of torts is discussed in the beginning with detail along with the various types of liabilities in torts specifically the rules of the Liability vis-à-vis Strict Liability and Absolute Liability, their evolution and applicability with special reference to India. Vicarious Liability is also explained in the terms of the relationship wherein this liability arises.
